Background

 
Training and Consulting Associates in partnership with National Council for Law Reporting (Kenya Law) will host a one week highly interactive and intensive Course on Policy and Legislative Drafting. 

The Course is a combination of formal teaching, practical exercises and group work with emphasis on “learning by doing”. 

The Course curriculum is accredited under the Law Society of Kenya CLE Programme.
 
Capacity Building for County Legislative Process
 

The Constitution has vested County Governments with exclusive jurisdiction of key functions. 

These functions will determine the content of county laws. 

Counties are expected to adopt key policy strategies and pass legislation on the assigned functions.
 
This course will contain a component that will create sustainable expert capacity to persons that are keen to assist County Governments in policy and legislative development. 

It will inculcate in them, at theoretical and practical level, the necessary analytical skills required to convert policies/views of members of the public into county laws.

Who should attend?
 
The Course aims to meet the needs of persons charged with the responsibility of policy formulation; legislative campaign, advocacy and lobbying; drafting laws, regulations and rules; law review and reform; law reporting; interpretation of laws; drafting bye laws, gazette and legal notices and persons working in licensing, regulatory, compliance and enforcement environments as well as tribunals, boards, committees and task forces among others.

Course Focus
  • Translating policy into legislation
  • Structure of a law: definitions, preliminary, substantive and subsidiary provisions
  • Amending legislation; repeals; transitional and saving provisions
  • Retrospective and retroactive provisions
  • Statutory interpretation and rules; drafting constraints
  • Specific legislation (licensing, regulatory, taxation, penal)
  • Subsidiary legislation: making rules, regulations, guidelines, bye laws etc.
  • Campaign, advocacy and lobbying in the legislative process
  • Managing effective public consultative process, public debate, education and sensitization
A certificate will be issued to those who successfully complete the Course.

Lead Faculty
 
Professor Rassie Malherbe - teaches Constitutional Law and Legislative Drafting at the University of Johannesburg and has presented numerous seminars on Legislative Drafting in South Africa and around the world. 

He also served as an advisor to the South Africa Constitution making process. 

He will be joined with other Kenyan experts.
